Terms and Condition

This website can be accessed at www.finmaster.co.za and is owned and operated by Findamentals (Pty) Ltd, trading as Fintr. FinMaster is our board game brand.

By using the website, browsing our products, or placing an order, you acknowledge that you have read, understood and agree to be bound by these Terms and Conditions. If you don't agree with them, please don't use the site.

FinMaster is proudly designed, developed and published in South Africa. We've written these terms in plain language on purpose — where the law gives you a right, we've said so rather than burying it in the fine print.

In these terms, "we", "us" and "our" mean the above entity. "You" means the person using the site or placing an order.

2. Definitions and legislation

      CPA — the Consumer Protection Act 68 of 2008

      ECTA — the Electronic Communications and Transactions Act 25 of 2002

      POPIA — the Protection of Personal Information Act 4 of 2013

      Cybercrimes Act — the Cybercrimes Act 19 of 2020

      Products — the FinMaster board game and any other goods we sell through the site

3. Placing an order

Everything shown on the site is an invitation to do business, not an offer. When you place an order you are making an offer to buy. A binding agreement comes into existence only when we dispatch your order and send you a dispatch confirmation — not when you receive an order acknowledgement.

Before you pay, our checkout gives you the opportunity to review the full transaction, correct any errors, and withdraw, as required by section 43(2) of ECTA.

We may decline or cancel an order where:

      The product is out of stock

      We can't verify your payment or the order looks fraudulent

      There's an obvious pricing or description error

      We can't ship to your address

If we cancel an order you've paid for, we refund you in full, promptly.

4. Pricing, VAT and errors

All prices on finmaster.co.za are shown in South African Rand (ZAR) and include VAT at 15% where we are a registered VAT vendor. Section 65 of the Value-Added Tax Act 89 of 1991 requires consumer-facing prices to be quoted VAT-inclusive, and ours are. The total price payable, including delivery, is displayed before you confirm payment.

Delivery charges are added at checkout and shown separately. For international orders, import duties and taxes are excluded — see our Shipping & Delivery Policy.

We may change prices at any time, but a price change never affects an order we've already accepted.

Obvious errors: if a product is listed at a clearly incorrect price — a decimal in the wrong place, a R799 game at R7.99 — we're not obliged to sell at that price. We'll contact you, cancel the order and refund you in full. This reflects section 23(9) of the CPA, which allows a supplier to correct an inadvertent and obvious pricing error.

5. Payment

We accept Visa and Mastercard debit and credit cards, instant EFT, Apple Pay and Google Pay.

Payments are processed by our payment providers, Paystack, over encrypted connections. We never see or store your full card details. Card data is handled by PCI-DSS compliant providers.

We only dispatch once payment has cleared in full.

6. Delivery, risk and ownership

Delivery is covered in full in our Shipping & Delivery Policy, which forms part of these terms.

Risk in the products passes to you on delivery. Ownership passes once we've received payment in full. Until then, the products remain ours.

7. Returns, refunds and your cooling-off right

Our Returns & Refunds Policy forms part of these terms and explains your rights in detail.

In summary: you have an unconditional 7-day statutory cooling-off right under section 44 of ECTA, which we voluntarily extend to 14 days for sealed, resalable games, and a 6-month right to return defective goods under sections 55 and 56 of the CPA, where you direct the remedy.

Delivery within 30 days. Under section 46 of ECTA, we must execute your order within thirty (30) days of receiving it unless we've agreed otherwise with you. If we don't, you may cancel on seven (7) days' written notice and we will refund you in full within thirty (30) days of that cancellation.

8. The product itself

FinMaster is a board game designed for ages 13 and up, for 2 to 6 players, with a play time of roughly 45 to 60 minutes. It contains small components. Adult supervision is recommended for younger players and the game is not suitable for children under 3 due to choking hazards.

We describe our products as accurately as we can. Photography, printing and screen calibration mean colours may vary slightly from what you see online. Component counts and contents may change between editions; the edition you receive will be the current one unless stated otherwise.

9. Educational content is not financial advice

FinMaster is a game about money, not a financial adviser. The asset classes, market events, returns and strategies in the game are simplified for entertainment and educational purposes. They are not investment advice, financial advice, tax advice, or a recommendation to buy or sell anything in the real world.

Nothing in the game, on our website, in our newsletters or on our social channels constitutes advice as contemplated in the Financial Advisory and Intermediary Services Act 37 of 2002. Please speak to a licensed financial adviser before making real financial decisions.

10. Your account

If you create an account, you're responsible for keeping your login details secure and for everything done under your account. Tell us immediately at finmaster@fintr.io if you think someone else has access.

You must give us accurate information and keep it up to date. We may suspend or close an account that is being used fraudulently or in breach of these terms.

11. Intellectual property

The FinMaster name, logo, game design, board artwork, card designs, rules, illustrations, the "Fintrs" currency, website copy and all other content are owned by us or our licensors and protected by copyright, trade mark and design law.

You may not reproduce, copy, distribute, sell, adapt, or create derivative works from any of it without our written permission. Buying a copy of the game gives you the right to play it, not to reproduce it.

You may photograph and film your own gameplay and share it on social media. We'd love that. Please tag us at @play_finmaster.

Commercial use — running paid events, tournaments, classroom programmes or team-building sessions using FinMaster — requires our written permission. Email finmaster@fintr.io; we're friendly about this.

12. Using our website

You agree not to:

      Use the site for any unlawful purpose

      Attempt to gain unauthorised access to our systems or data

      Introduce viruses, malware or other harmful code

      Scrape, harvest or systematically extract content

      Interfere with the site's operation or another user's use of it

Unauthorised access to, interception of, or interference with our systems or data is a criminal offence under sections 2 to 6 of the Cybercrimes Act 19 of 2020. We report attempts.

13. Content you submit

If you post a review, comment or other content on our site or channels, you confirm it's yours to post and grant us a non-exclusive, royalty-free licence to use, reproduce and display it in connection with FinMaster.

We may remove content that is unlawful, defamatory, offensive, or misleading. We don't routinely monitor user content and aren't responsible for opinions expressed in it.

14. Availability of the site

We work to keep finmaster.co.za available and accurate, but we don't guarantee uninterrupted access. We may suspend the site for maintenance, updates or reasons beyond our control, without notice and without liability.

15. Links to other sites

Our site links to third-party retailers and resources. We don't control those sites and aren't responsible for their content, products or privacy practices. A link is not an endorsement.

16. Limitation of liability

⚠️ PLEASE READ THIS CLAUSE AND CLAUSE 17 CAREFULLY. They limit our liability to you and require you to indemnify us in certain circumstances. We draw them to your attention specifically, as required by section 49 of the CPA, because they are risk-limiting provisions. If anything here is unclear, email finmaster@fintr.io before you order.

Nothing in these terms limits or excludes:

      Your rights under the CPA or any other law that cannot lawfully be excluded

      Our liability for death or personal injury caused by our negligence

      Our liability for fraud or fraudulent misrepresentation

      Our liability under section 61 of the CPA for harm caused by unsafe goods, a product failure, defect or hazard, or inadequate instructions or warnings. This is strict liability and cannot be contracted out of

Subject to that, and to the fullest extent permitted by law:

      We are not liable for indirect, incidental, special or consequential loss, including loss of profit, loss of data, or loss of opportunity

      Our total liability arising from any order is limited to the amount you paid for that order

      We are not liable for delays or failures caused by events outside our reasonable control, including load shedding, courier disruption, natural events, or acts of government

You use the site and the information on it at your own risk.

17. Indemnity

You indemnify us against claims, losses and costs arising from your breach of these terms, your unlawful use of the site, or your infringement of anyone else's rights.

18. Privacy and personal information

We process your personal information in accordance with POPIA and our Privacy Policy and Cookie Policy, which form part of these terms.

19. Electronic communications

By using the site you consent to receiving communications from us electronically. Emails, order confirmations and notices sent electronically satisfy any legal requirement that communications be in writing, as contemplated by ECTA.

Marketing emails are only sent where you've opted in, and every one includes an unsubscribe link. You can also opt out at any time by emailing finmaster@fintr.io. We process direct marketing in line with section 69 of POPIA, which permits us to market to existing customers in respect of similar products, and otherwise requires your prior consent.

20. Changes to these terms

We may update these terms from time to time. The version published on the site when you place an order is the version that applies to that order. The "last updated" date at the top tells you when we last changed anything.

21. Complaints and dispute resolution

Start by emailing finmaster@fintr.io. We take complaints seriously and will acknowledge yours within 36 hours and respond substantively within 10 business days.

If we can't resolve it between us, you may refer the dispute at no cost to:

You always retain the right to approach a court of competent jurisdiction.

22. General

Governing law: these terms are governed by the laws of the Republic of South Africa, and you consent to the jurisdiction of the Western Cape Division of the High Court regardless of the value of the claim.

Severability: if any provision is found unenforceable, the rest of these terms continue to apply.

No waiver: if we don't enforce a right immediately, we haven't given it up.

Whole agreement: these terms, together with our Returns & Refunds Policy, Shipping & Delivery Policy, Privacy Policy and Cookie Policy, make up the entire agreement between us.

Cession: you may not cede or assign your rights under these terms without our written consent.
